revenue election payment\nThe term \u201caverage crop revenue election payment\u201d means a payment made to producers on a farm under section 8715\n1\n1 See References in Text note below.\n(2)\nBase acres\n(A)\nIn general\nThe term \u201cbase acres\u201d, with respect to a covered commodity on a farm, means the number of acres established under\nsection 7911 of this title\nSeptember 30, 2007\nsection 8711 of this title\n(B)\nPeanuts\nThe term \u201cbase acres for peanuts\u201d has the meaning given the term in\nsection 8751 of this title\n(3)\nCounter-cyclical payment\nThe term \u201ccounter-cyclical payment\u201d means a payment made to producers on a farm under section 8714\n1\n(4)\nCovered commodity\nThe term \u201ccovered commodity\u201d means wheat, corn, grain sorghum, barley, oats, upland cotton, long grain rice, medium grain rice, pulse crops, soybeans, and other oilseeds.\n(5)\nDirect payment\nThe term \u201cdirect payment\u201d means a payment made to producers on a farm under section 8713\n1\n(6)\nEffective price\nThe term \u201ceffective price\u201d, with respect to a covered commodity for a crop year, means the price calculated by the Secretary under section 8714\n1\n(7)\nExtra long staple cotton\nThe term \u201cextra long staple cotton\u201d means cotton that\u2014\n(A) is produced from pure strain varieties of the Barbadense species or any hybrid of the species, or other similar types of extra long staple cotton, designated by the Secretary, having characteristics needed for various end uses for which United States upland cotton is not suitable and grown in irrigated cotton-growing regions of the United States designated by the Secretary or other areas designated by the Secretary as suitable for the production of the varieties or types; and\n(B) is ginned on a roller-type gin or, if authorized by the Secretary, ginned on another type gin for experimental purposes.\n(8)\nLoan commodity\nThe term \u201cloan commodity\u201d means wheat, corn, grain sorghum, barley, oats, upland cotton, extra long staple cotton, long grain rice, medium grain rice, soybeans, other oilseeds, graded wool, nongraded wool, mohair, honey, dry peas, lentils, small chickpeas, and large chickpeas.\n(9)\nMedium grain rice\nThe term \u201cmedium grain rice\u201d includes short grain rice.\n(10)\nOther oilseed\nThe term \u201cother oilseed\u201d means a crop of sunflower seed, rapeseed, canola, safflower, flaxseed, mustard seed, crambe, sesame seed, or any oilseed designated by the Secretary.\n(11)\nPayment acres\nThe term \u201cpayment acres\u201d means, in the case of direct payments and counter-cyclical payments\u2014\n(A) except as provided in subparagraph (B), 85 percent of the base acres of a covered commodity on a farm on which direct payments or counter-cyclical payments are made; and\n(B) in the case of direct payments for each of the 2009 through 2011 crop years, 83.3 percent of the base acres for the covered commodity on a farm on which direct payments are made.\n(12)\nPayment yield\nThe term \u201cpayment yield\u201d means the yield established for direct payments and the yield established for counter-cyclical payments under\nsection 7912 of this title\nSeptember 30, 2007\nsection 8712 of this title\n(13)\nProducer\n(A)\nIn general\nThe term \u201cproducer\u201d means an owner, operator, landlord, tenant, or sharecropper that shares in the risk of producing a crop and is entitled to share in the crop available for marketing from the farm, or would have shared had the crop been produced.\n(B)\nHybrid seed\nIn determining whether a grower of hybrid seed is a producer, the Secretary shall\u2014\n(i) not take into consideration the existence of a hybrid seed contract; and\n(ii) ensure that program requirements do not adversely affect the ability of the grower to receive a payment under this chapter.\n(14)\nPulse crop\nThe term \u201cpulse crop\u201d means dry peas, lentils, small chickpeas, and large chickpeas.\n(15)\nState\nThe term \u201cState\u201d means\u2014\n(A) a State;\n(B) the District of Columbia;\n(C) the Commonwealth of Puerto Rico; and\n(D) any other territory or possession of the United States.\n(16)\nTarget price\nThe term \u201ctarget price\u201d means the price per bushel, pound, or hundredweight (or other appropriate unit) of a covered commodity used to determine the payment rate for counter-cyclical payments.\n(17)\nUnited States\nThe term \u201cUnited States\u201d, when used in a geographical sense, means all of the States.\n(18)\nUnited States Premium Factor\nThe term \u201cUnited States Premium Factor\u201d means the percentage by which the difference in the United States loan schedule premiums for Strict Middling (SM) 1\u215b-inch upland cotton and for Middling (M)
