{"identifier":"/us/usc/t7/s8901","title":7,"num":"\u00a7\u202f8901.","heading":"Definitions","text":"\u00a7\u202f8901.\nDefinitions\nIn this chapter:\n(1)\nAgent\nThe term \u201cagent\u201d means a nuclear, biological, chemical, or radiological substance that causes agricultural disease or the adulteration of products regulated by the Secretary of Agriculture under any provision of law.\n(2)\nAgricultural biosecurity\nThe term \u201cagricultural biosecurity\u201d means protection from an agent that poses a threat to\u2014\n(A) plant or animal health;\n(B) public health as it relates to the adulteration of products regulated by the Secretary of Agriculture under any provision of law that is caused by exposure to an agent; or\n(C) the environment as it relates to agriculture facilities, farmland, and air and water within the immediate vicinity of an area associated with an agricultural disease or outbreak.\n(3)\nAgricultural countermeasure\nThe term \u201cagricultural countermeasure\u201d\u2014\n(A) means a product, practice, or technology that is intended to enhance or maintain the agricultural biosecurity of the United States; and\n(B) does not include a product, practice, or technology used solely in response to a human medical incident or public health emergency not related to agriculture.\n(4)\nAgricultural disease\nThe term \u201cagricultural disease\u201d has the meaning given the term by the Secretary.\n(5)\nAgricultural disease emergency\nThe term \u201cagricultural disease emergency\u201d means an incident of agricultural disease that requires prompt action to prevent significant damage to people, plants, or animals.\n(6)\nAgroterrorist act\nThe term \u201cagroterrorist act\u201d means an act that\u2014\n(A) causes or attempts to cause\u2014\n(i) damage to agriculture; or\n(ii) injury to a person associated with agriculture; and\n(B) is committed or appears to be committed with the intent to\u2014\n(i) intimidate or coerce a civilian population; or\n(ii) disrupt the agricultural industry in order to influence the policy of a government by intimidation or coercion.\n(7)\nAnimal\nThe term \u201canimal\u201d has the meaning given the term in\nsection 8302 of this title\n(8)\nDepartment\nThe term \u201cDepartment\u201d means the Department of Agriculture.\n(9)\nDevelopment\nThe term \u201cdevelopment\u201d means\u2014\n(A) research leading to the identification of products or technologies intended for use as agricultural countermeasures to protect animal health;\n(B) the formulation, production, and subsequent modification of those products or technologies;\n(C) the conduct of in vitro and in vivo studies;\n(D) the conduct of field, efficacy, and safety studies;\n(E) the preparation of an application for marketing approval for submission to an applicable agency;
